GENERAL TERMS AND CONDITIONS

These General Terms & Conditions apply to the use of The Nest Golf Studio's premises, facilities, golf simulator bays, equipment and services. They apply to all customers, members, casual users, event organisers, event attendees, guests and visitors (collectively, “Customers”).
Additional terms may apply to particular products or services, including memberships, private events, coaching, competitions, gift cards and prepaid packs. Where additional terms apply, they operate together with these General Terms & Conditions.
By making a booking, purchasing or using a service, attending the premises or otherwise using The Nest Golf Studio facilities, you agree to comply with these General Terms & Conditions.
1. BOOKINGS & FACILITY ACCESS
Casual Bookings
Casual simulator bookings are subject to availability and must be made through The Nest Golf Studio's approved booking system or directly with The Nest Golf Studio.
Casual bookings provide access to the simulator bay for the period booked. Customers must finish play and vacate the simulator bay promptly at the end of their allocated booking time.
Casual Access
Casual customers may access the studio during staffed hours or other approved access periods associated with their booking.
Access outside staffed hours is limited to customers with an eligible membership or where specifically authorised by The Nest Golf Studio.
Staffed hours and facility availability may change from time to time.
Booking Cancellations
Casual bookings must be cancelled or rescheduled at least 2 hours before the scheduled booking time.
Bookings cancelled less than 2 hours before the scheduled start time, or missed without cancellation, may be forfeited and are not eligible for a refund or credit, subject to any rights available under Australian Consumer Law.
Studio Availability
The Nest Golf Studio may temporarily restrict or close access to all or part of the facility where reasonably necessary for maintenance, repairs, events, safety, emergencies or other operational requirements.
Where reasonably practicable, customers affected by a scheduled booking will be notified and appropriate arrangements made.
2. PRIVATE HIRE & EVENTS
Private events and corporate hire are subject to availability and prior approval by The Nest Golf Studio.
Private hire bookings may also be subject to a separate Private Event & Corporate Hire Agreement, which sets out the event-specific details, inclusions, fees, payment terms, cancellation conditions and other requirements.
Where an Event Agreement applies, it operates in addition to these General Terms & Conditions.
Event organisers are responsible for ensuring their attendees are aware of and comply with applicable facility and safety rules.
The Nest Golf Studio reserves the right to refuse entry to, or require the removal of, any person whose behaviour is unsafe, abusive, intoxicated, disruptive or likely to cause injury or damage.
Where an event is discontinued due to the conduct of the event organiser or attendees, refunds will not ordinarily be provided, subject to rights available under Australian Consumer Law.
3. ALCOHOL
The Nest Golf Studio is an unlicensed venue.
Alcohol must not be brought onto or consumed anywhere on the premises.
This applies to all customers, members, guests, visitors and event attendees.
The Nest Golf Studio reserves the right to refuse entry or require a person to leave the premises where they are intoxicated or where their behaviour creates a safety, security or facility risk.
Failure to comply with the alcohol policy may result in removal from the premises and suspension or termination of access to The Nest Golf Studio.
4. SMOKING & VAPING
Smoking and vaping are not permitted anywhere inside The Nest Golf Studio.
5. CHILDREN & MINORS
Children under 16 years of age must be accompanied and actively supervised by a parent, guardian or responsible adult at all times while at The Nest Golf Studio.
The supervising adult is responsible for ensuring children in their care comply with all facility and safety requirements.
Children must not run through the studio, enter an active hitting area while another person is playing, interfere with equipment, or behave in a way that creates a safety risk or unreasonably disrupts other customers.
The Nest Golf Studio does not host children's parties.
6. SIMULATOR & HITTING BAY SAFETY
Customers must use the simulator bays, golf equipment and other facilities safely and appropriately.
Customers must follow all safety guidelines, facility rules and reasonable instructions provided by The Nest Golf Studio staff. Failure to follow safety requirements, facility rules or reasonable staff directions may result in play being stopped and/or the Customer being required to leave the premises.
Customers are responsible for using equipment in accordance with its intended purpose and for following the safety requirements outlined in these General Terms & Conditions.
The following rules apply:

All golf swings must take place within the designated hitting area.

Only the person actively hitting may enter the hitting area while a bay is in use.

Other persons must maintain a safe distance from the person swinging.

Run-ups, trick shots, intentionally dangerous swings and shots not directed towards the impact screen are prohibited.

Food and drinks must be kept outside the designated hitting area and placed on the tables or other appropriate surfaces provided.

Appropriate footwear must be worn.

Equipment must be used only for its intended purpose and in accordance with any instructions provided by The Nest Golf Studio.

Customers must not intentionally strike, tamper with, move or misuse simulator technology or other studio equipment.
7. GOLF BALLS & CLUBS
Golf club faces must be clean and free from dirt, mud, grass and sand before being used in the simulator bays.
Customers may use golf balls supplied by The Nest Golf Studio or their own golf balls, provided personal golf balls are clean, undamaged and suitable for simulator use.
Golf balls must be clean and free from dirt, mud, grass and sand. Damaged, heavily scuffed, marked or dirty golf balls must not be used.
Paint, ink, stamps or other substances must not be applied to golf balls or club faces where they may transfer onto or damage the impact screens.
Customers may be responsible for damage caused by the use of inappropriate, dirty or damaged equipment.
8. CUSTOMER CONDUCT
All customers, guests and visitors are expected to behave respectfully and appropriately while at The Nest Golf Studio.
Customers must:

treat staff, other customers and visitors with respect;
-
avoid abusive, threatening, intimidating, discriminatory or harassing behaviour;
-
use the studio, simulator bays and equipment safely and appropriately;
-
not deliberately misuse, abuse or damage equipment or property;
-
not engage in behaviour that creates an unreasonable risk to themselves, other people, the facility or equipment; and
-
comply with reasonable directions given by The Nest Golf Studio staff.
Customers are responsible for the conduct of any guests they bring onto the premises and must ensure their guests comply with these General Terms & Conditions and applicable facility rules.
The Nest Golf Studio reserves the right to refuse entry, stop play, or require any person to leave the premises where their behaviour is unsafe, threatening, abusive, harassing, disruptive, damaging to equipment or property, or otherwise places customers, staff or the facility at risk.
Where a booking or session is ended early, or a person is required to leave the premises, due to their unsafe, threatening, abusive, harassing or disruptive behaviour, misuse of equipment, deliberate or negligent damage, or serious breach of these General Terms & Conditions, the remaining booking time will be forfeited and no refund or credit will be provided, subject to any rights available under Australian Consumer Law.
Serious or repeated breaches may result in suspension or termination of access to The Nest Golf Studio.
9. CLEANLINESS
Customers are expected to leave the studio, simulator bays and shared areas in a reasonably clean and tidy condition.
Rubbish must be placed in the bins provided.
Event organisers may have additional cleaning and rubbish-removal responsibilities under their Private Event & Corporate Hire Agreement.
10. EQUIPMENT & PROPERTY DAMAGE
Customers are responsible for using The Nest Golf Studio's facilities, simulator equipment, golf equipment and other property safely, appropriately and for their intended purpose.
Where a Customer, or a guest under their booking, causes damage to the premises, equipment or other property through misuse, negligence, tampering, deliberate conduct or failure to comply with these General Terms & Conditions or reasonable staff directions, the Customer may be held responsible for the reasonable costs of repairing the damage.
Where repair is not reasonably possible, the Customer may be responsible for the reasonable cost of replacement.
Customers are not responsible for normal wear and tear, equipment failure, or damage arising from ordinary and appropriate use.
Any damage or equipment fault should be reported to The Nest Golf Studio as soon as reasonably practicable.
For private hire and events, the Event Organiser may be held responsible for damage caused by attendees under their booking where provided for in the applicable Private Event & Corporate Hire Agreement.
11. EMERGENCIES & INCIDENT REPORTING
Customers should familiarise themselves with the location of emergency exits and follow any emergency instructions provided at the premises.
Accidents, injuries, damage, equipment faults, safety concerns or other significant incidents should be reported to The Nest Golf Studio as soon as reasonably practicable.

In an emergency requiring immediate assistance, customers should contact emergency services by calling 000.
The Nest Golf Studio may review reported incidents and available security footage where reasonably necessary to investigate an incident, address safety concerns or prevent recurrence.
12. CCTV & SECURITY
The Nest Golf Studio uses video surveillance within the facility and around designated external entry areas for security, safety and incident management purposes.
CCTV may operate 24 hours a day.
Footage may be reviewed where reasonably necessary for security, safety, investigation of incidents, protection of customers or protection of the facility and equipment.
Personal information collected through CCTV is handled in accordance with The Nest Golf Studio's Privacy Policy.
13. PERSONAL PROPERTY
Customers are responsible for their personal belongings while at The Nest Golf Studio.
To the extent permitted by law, The Nest Golf Studio is not responsible for loss, theft or damage to personal property left unattended at the premises.
Customers should ensure they take all personal belongings with them when leaving the studio.
14. HEALTH, PHYSICAL ACTIVITY & ASSUMPTION OF RISK
Use of golf simulators and participation in golf, coaching, competitions and related activities involve physical activity and inherent risks, including risks associated with swinging golf clubs, golf balls, equipment, slips, trips, falls and interaction with other participants.
Customers are responsible for considering their own physical condition, ability and limitations before participating.
Customers must stop participating if they believe an activity is unsafe for them and should seek appropriate professional advice where necessary.
Customers must comply with facility safety requirements and reasonable safety directions given by The Nest Golf Studio.
LIABILITY
By becoming a customer, you release and indemnify The Nest, its staff, servants, and agents against all claims relating to any injury, loss, or serious harm caused to you or your property.
15. PREPAID TOP UP PACKS
The Nest Golf Studio may offer prepaid Top Up Packs that provide account credit for use towards eligible services.
Current Top Up Packs include:
Par 5: $175 purchase price providing $200 credit.
Fairway 10: $300 purchase price providing $400 credit.
Top Up Pack credit may be used towards:
-
simulator bookings;
-
eligible competition entries; and
-
equipment hire.
Top Up Packs are prepaid products and require payment in full at the time of purchase.
Top Up Packs:
-
are not memberships and do not independently provide 24/7 studio access;
-
may only be used during access periods otherwise available to the customer;
-
are non-transferable;
-
are applied to the account of the customer who purchased the pack; and
-
account credit is valid for 12 months from the date the balance was last changed. Each subsequent change to the account credit balance resets the 12-month validity period.
Any unused credit remaining after the applicable expiry date will expire, subject to any rights available under Australian Consumer Law.
Customers who also hold an eligible membership providing 24/7 access may use their Top Up Pack credit for eligible bookings during their permitted access periods.
Bookings made using Top Up Pack credit remain subject to The Nest Golf Studio's standard booking and cancellation conditions.
16. PURCHASED GIFT CARDS
Gift Cards purchased from The Nest Golf Studio may be redeemed towards eligible products and services available through The Nest Golf Studio, subject to any conditions stated at the time of purchase.
Purchased Gift Cards currently have no expiry date prior to redemption.
Gift Cards are not redeemable for cash except where required by law.
Once a Gift Card has been sent to the nominated recipient, the recipient's email address cannot be changed by The Nest Golf Studio. Customers are responsible for ensuring recipient details are correct before the Gift Card is sent.
Once a Gift Card is redeemed, its value is transferred to the recipient's Your Golf Booking account as account credit. Account credit is valid for 12 months from the date the balance was last changed. Each subsequent change to the account credit balance resets the 12-month validity period.
Gift Cards are non-transferable and, once redeemed, the resulting account credit remains attached to the account to which it was redeemed.
Any additional conditions applicable to a Gift Card will be displayed at or before the time of purchase.
17. PROMOTIONAL VOUCHERS
From time to time, The Nest Golf Studio may issue complimentary or promotional vouchers, credits, prizes or offers.
Promotional vouchers may be subject to specific conditions, including an individual expiry date, eligible services, redemption period or other restrictions.
Any applicable expiry date and conditions will be stated on or provided with the promotional voucher.
Promotional vouchers are not redeemable for cash and are subject to the specific conditions under which they were issued and applicable law.
18. PRIVACY
The Nest Golf Studio collects and handles personal information in accordance with our Privacy Policy.
The Privacy Policy explains how personal information may be collected, used, stored and disclosed and how customers may contact us regarding their personal information.
19. AUSTRALIAN CONSUMER LAW
Nothing in these General Terms & Conditions is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
20. CHANGES TO THESE TERMS
The Nest Golf Studio may update these General Terms & Conditions from time to time.
The current version will be published on The Nest Golf Studio website together with the date it was last updated.
Changes will apply from the date specified in the updated Terms. Where a change materially affects an existing membership or other ongoing contractual arrangement, any additional applicable terms governing that arrangement will also apply.
21. GOVERNING LAW
These General Terms & Conditions are governed by the laws of South Australia and applicable Commonwealth laws of Australia
