MEMBER TERMS AND CONDITIONS

These Membership Terms & Conditions apply to memberships offered by The Nest Golf Studio.

They operate in addition to The Nest Golf Studio General Terms & Conditions, which apply to all members, customers, guests and users of the facility.

By purchasing or using a membership, the Member agrees to comply with both these Membership Terms & Conditions and The Nest Golf Studio General Terms & Conditions.

Individual memberships may have additional terms displayed at the time of purchase, including the membership price, minimum commitment period, included sessions, billing frequency, booking window and membership benefits. Those product-specific terms form part of the Member's agreement with The Nest Golf Studio.

Where there is an inconsistency between these Membership Terms and a product-specific term expressly provided at the time of purchase, the product-specific term will apply to that membership to the extent of the inconsistency.

1. MEMBERSHIP TYPES

The Nest Golf Studio may offer different membership categories from time to time.

Membership inclusions, pricing and benefits vary depending on the membership purchased and will be displayed at or before the time of purchase.

Elite Memberships

Memberships designated by The Nest Golf Studio as Elite Memberships include:

9x 1hr simulator sessions each membership period;
24/7 member access;
advance bookings up to 4 weeks in advance;
25% off additional simulator sessions;
$20 off eligible golf lessons; and
other Elite Member benefits offered from time to time.
$10 Bring a Mate fee per guest, per hour, subject to the applicable Bring a Mate conditions.

Current Elite Memberships include Birdie, Eagle and Albatross.

The session allocation, pricing, minimum commitment and any other membership-specific conditions applicable to each Elite Membership will be displayed at or before the time of purchase.

Access Memberships

Memberships designated by The Nest Golf Studio as Access Memberships provide 24/7 member access to the studio, with additional inclusions and benefits varying according to the membership purchased.

Current and planned Access Memberships include:

Tee Time Access

Tee Time Access includes:

24/7 studio access;
simulator bookings purchased separately at the applicable casual rate or using eligible account credit; and
no minimum commitment period, subject to the applicable cancellation notice requirements.

Par Membership

Par Membership includes:

1x 1hr simulator session per week;
24/7 member access;
advance bookings up to 2 weeks in advance;
25% off additional simulator sessions; and
$10 Bring a Mate fee per guest, per hour, subject to the applicable Bring a Mate conditions.

Specific session allocations, pricing, minimum commitment and any other membership-specific conditions will be displayed at or before purchase.

Access Memberships do not receive Elite Membership benefits unless expressly included with the applicable membership.

Other Memberships

The Nest Golf Studio may introduce additional membership types, limited-edition memberships or promotional memberships from time to time.

The price, duration, inclusions, restrictions, minimum commitment (if applicable) and other specific conditions of those memberships will be displayed at or before purchase and will operate together with these Membership Terms & Conditions.

Bring a Mate Benefit

Where included with a membership, the Member may add eligible guests to their simulator booking for a Bring a Mate fee of $10 per guest, per hour.

The Member must be present and participating in the booking. The Bring a Mate benefit does not provide the guest with independent studio access or a separate simulator booking and cannot be used to make bookings on behalf of another person.

Guest Limit: A maximum of four total people per simulator bay is permitted at any one time, including the Member.

The Member is responsible for ensuring their guests comply with The Nest Golf Studio General Terms & Conditions and facility rules.

Example: If a Member brings two guests for a two-hour simulator booking, the Bring a Mate fee is $40 (2 guests × 2 hours × $10).

2. MEMBERSHIP COMMENCEMENT & MINIMUM PAYMENT COMMITMENT

A membership begins on the commencement date specified at the time of purchase.

Some memberships are subject to a minimum payment commitment, consisting of a specified number of successfully paid membership billing periods. The applicable minimum payment commitment will be clearly displayed before purchase and forms part of the Member's agreement.

A billing period will count towards the minimum commitment only once the applicable membership payment for that period has been successfully received.

A failed, declined, reversed or otherwise unpaid membership payment does not count towards completion of the minimum commitment.

For example, where a membership has a six-payment minimum commitment, the Member is required to complete six successful membership payments before the minimum commitment is satisfied.

A Member cannot ordinarily cancel a membership before completing the applicable minimum commitment except where permitted under these Membership Terms, the product-specific terms, or applicable law.

After the minimum commitment has been completed, recurring memberships will continue on an ongoing basis until cancelled in accordance with these Membership Terms.

An approved membership suspension or hold does not count as a paid membership period towards the minimum commitment. The remaining minimum commitment resumes when the membership is reactivated.

3. MEMBERSHIP PAYMENTS

Recurring membership fees are automatically charged to the payment method provided by the Member at the applicable billing interval.

The Member authorises The Nest Golf Studio and its payment providers to process recurring membership payments in accordance with the membership purchased.

Members are responsible for maintaining a valid payment method and ensuring sufficient funds are available when payment is due.

Membership pricing applicable at the time of purchase will be displayed before checkout.

4. FAILED OR OVERDUE PAYMENTS

If a scheduled membership payment is declined or unsuccessful, The Nest Golf Studio may attempt to reprocess the outstanding payment up to three times using the payment method associated with the Member's account.

The Nest Golf Studio may suspend the membership and associated membership benefits while any membership payment remains outstanding.

During a suspension for non-payment, the Member may lose access to:

24/7 studio access;
member booking privileges;
membership session allocations;
member pricing and discounts; and
other membership benefits.

A failed or unpaid billing period does not count towards completion of any applicable minimum payment commitment.

Suspension for non-payment does not cancel the membership or release the Member from an existing minimum payment commitment.

Members are responsible for maintaining a valid payment method and for paying any outstanding membership fees.

Debt Recovery

Where an amount remains unpaid after reasonable attempts to obtain payment, The Nest Golf Studio may refer the outstanding amount to a debt collection service.

The Member may be responsible for reasonable third-party recovery costs to the extent permitted by law.

5. MEMBERSHIP SESSION ALLOCATIONS

Where a membership includes simulator sessions, the number and duration of included sessions will be specified as part of that membership.

Included sessions must be used within the applicable membership period and do not roll over unless expressly stated otherwise for that membership.

Unused sessions have no cash value and cannot be transferred to another Member.

Where permitted by the applicable membership, additional simulator time may be purchased at the applicable Member rate.

Members are responsible for monitoring and using their session allocation within the applicable period.

Maximum Booking Use

Where a membership is subject to daily or booking limits, those limits will be displayed as part of the membership inclusions.

6. MEMBER BOOKING ACCESS

All simulator use remains subject to availability and requires a valid booking.

Membership does not guarantee availability of a particular bay, date or time.

The advance booking window applicable to each membership will be specified as part of that membership's benefits.

Membership bookings are also subject to the booking and cancellation provisions contained in The Nest Golf Studio General Terms & Conditions.

Simulator bookings are subject to a maximum of four (4) consecutive hours per booking, in accordance with The Nest Golf Studio General Terms & Conditions.

7. 24/7 MEMBER ACCESS

Where 24/7 access is included with a membership, the Member may access The Nest Golf Studio outside staffed hours in connection with an eligible booking and in accordance with applicable access procedures.

Members may receive an access code or other access credentials through The Nest Golf Studio's booking/access system.

Access credentials are for the authorised Member and their permitted booking only and must not be shared with unauthorised persons.

Members must not use their access privileges to provide independent studio access to another person who is not authorised to access the facility.

24/7 access remains subject to temporary closures or restrictions for maintenance, private events, safety, emergencies or other reasonable operational requirements.

Members must ensure the premises are secure when entering and leaving outside staffed hours and must not permit unknown or unauthorised persons to enter the facility.

New Member Registration & Identification

All new Members must complete The Nest Golf Studio New Member Form, which will be provided as part of the membership welcome process.

Valid photo identification is required before 24/7 studio access will be activated.

The Nest Golf Studio may withhold or temporarily pause a Member's 24/7 access until the completed New Member Form and required identification have been received and verified.

Members are responsible for completing these requirements promptly following commencement of their membership.

8. MEMBER GUESTS

Members may bring guests where permitted by their membership and booking conditions.

Any applicable guest limits or charges will be displayed as part of the membership or booking conditions.

The Member is responsible for ensuring their guests comply with The Nest Golf Studio General Terms & Conditions and facility rules.

Guests do not obtain independent 24/7 access rights by attending with a Member.

9. MEMBERSHIP BENEFITS & DISCOUNTS

Membership benefits vary according to membership type.

Benefits may include booking privileges, simulator-session allocations, discounted additional sessions, coaching discounts, event access or other offers.

Unless expressly stated otherwise:

benefits are for the Member's personal use;
benefits cannot be transferred or exchanged for cash;
discounts cannot be retrospectively applied to previous purchases; and
eligibility for a benefit may depend on the Member maintaining an active and fully paid membership.

Benefits specific to a membership will be displayed as part of that membership's inclusions.

10. MEMBERSHIP CANCELLATION

Memberships With a Minimum Payment Commitment

A membership subject to a minimum payment commitment cannot ordinarily be cancelled before the required number of successful membership payments has been completed.

Once the minimum payment commitment has been completed, the Member may cancel the membership by providing at least 30 days' written notice to:

If a scheduled membership payment falls due during the 30-day notice period, that payment will be processed and membership access and benefits will continue through the corresponding paid period.

Memberships Without a Minimum Commitment

Where a membership is expressly sold as having no minimum commitment, the Member may request cancellation at any time by providing a minimum of 30 days' written notice to:

Membership payments scheduled during the 30-day notice period will continue to be processed, and the Member will retain their applicable membership access and benefits for the corresponding paid period.

The membership will end once the applicable notice period and paid membership period have concluded.

11. MEDICAL CANCELLATION

A Member may request early cancellation of a membership with a minimum payment commitment where a serious medical condition prevents them from reasonably continuing to use The Nest Golf Studio.

The Nest Golf Studio may request reasonable supporting documentation from an appropriately qualified medical practitioner confirming that the Member is unable to continue using the facility.

Where an eligible medical cancellation is approved, the membership will end without an early termination fee.

12. TEMPORARY MEDICAL SUSPENSION

Members who are temporarily unable to use the facility due to injury or a medical condition may request a temporary membership suspension.

The Nest Golf Studio may request reasonable supporting documentation confirming the expected period during which the Member cannot participate.

Approved suspensions may be granted for the documented recovery period, up to a maximum of 6 months.

During an approved suspension:

recurring membership payments will be paused;
membership access and benefits will be suspended; and
the Member's remaining minimum payment commitment will resume when the membership is reactivated.

13. MEMBERSHIP TERMINATION BY THE NEST

The Nest Golf Studio may suspend or terminate a membership where a Member:

fails to pay membership fees when due;
seriously or repeatedly breaches these Membership Terms or the General Terms & Conditions;
shares or misuses 24/7 access credentials;
provides unauthorised access to the studio;
deliberately damages, misuses or tampers with equipment or property, or causes damage through negligent use;
engages in serious misconduct, harassment, threatening or unsafe behaviour; or
otherwise seriously misuses membership privileges.

Where reasonably appropriate, The Nest Golf Studio may provide the Member with an opportunity to remedy a breach before terminating the membership.

Serious misconduct, safety risks, deliberate damage or other significant breaches may result in immediate suspension or termination.

Where a membership is terminated because of the Member's serious breach, amounts already paid are not ordinarily refundable and outstanding amounts relating to services already provided or obligations already incurred remain payable, subject to applicable law.

14. NON-TRANSFERABILITY

Memberships are personal to the named Member and are non-transferable.

A membership, included session allocation, membership discount, access credential or other membership benefit must not be sold, transferred, shared or provided to another person unless expressly permitted by The Nest Golf Studio.

15. MEMBERSHIP ACCOUNT INFORMATION

Members are responsible for ensuring the information provided when establishing their membership is accurate.

Members should notify The Nest Golf Studio of changes to their contact information where those details are capable of being updated.

The email address associated with a Trackman / Your Golf Booking membership account cannot currently be changed by The Nest Golf Studio once the membership account has been created. Members are responsible for ensuring the correct email address is provided before completing their membership purchase.

16. CHANGES TO MEMBERSHIP TERMS & BENEFITS

The Nest Golf Studio may update these Membership Terms & Conditions from time to time.

The current version will be published on The Nest Golf Studio website.

Any changes will apply subject to applicable law and the product-specific terms agreed to when a Member purchased their membership.

Material changes will not retrospectively alter a Member's agreed minimum payment commitment or membership price during that minimum commitment, unless agreed with the Member or otherwise permitted by law.

17. GENERAL TERMS & CONDITIONS

All Members remain subject to The Nest Golf Studio General Terms & Conditions, including requirements relating to:

facility and hitting-bay safety;
alcohol;
children and supervision;
customer conduct;
equipment and property damage;
cleanliness;
CCTV and security;
personal property;
health, physical activity and assumption of risk; and
privacy.

Where relevant, members are also subject to any additional product-specific conditions displayed and accepted at the time of purchase.

18. AUSTRALIAN CONSUMER LAW

Nothing in these Membership Terms & Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

19. GOVERNING LAW

These Membership Terms & Conditions are governed by the laws of South Australia and applicable Commonwealth laws of Australia.
